Terms of Service

These Terms of Service ("Terms") govern access to and use of the MMENTO™ mobile application (the "App"), the website at mmentoapp.com (the "Website"), and any related products and features (collectively, the "Services") operated by Display Group LTD ("MMENTO", "we", "us", or "our"), under company number 16102028.
By creating an account, downloading the App, or otherwise using the Services, you accept these Terms in full. If you do not accept them, please do not use the Services.
1. Eligibility
The Services are intended for users aged sixteen (16) years or older. By using the Services, you represent that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.
If we become aware that an account has been created by a person under the applicable age, we will suspend or delete the account.
2. Account Registration
To access the App, you must create an account using a valid email address and password, or through a supported third-party sign-in provider. You are responsible for:
- Providing accurate and up-to-date registration information.
- Maintaining the confidentiality of your access credentials.
- All activities that occur under your account.
You agree to notify us immediately at our contact form if you suspect any unauthorised use of your account.
3. Description of the Services
MMENTO™ is composed of the following components:
- MMENTO App — a private digital repertory where individual users store, organise, and manage their own magic-related content (notes, ideas, routines, and associated media).
- MMENTO Explore — a vertical search interface that presents publicly available information about magic-related products commercialised by third-party retailers, reinterpreted and summarised under MMENTO's editorial criteria.
- MMENTO AI — an internal intelligence layer that enhances how the App and Explore organise, classify, and surface content. MMENTO AI is not, at this stage, a feature directly accessible to users; its operation is described in detail in the Transparency section dedicated to MMENTO AI.
We may modify, expand, suspend, or discontinue any component of the Services at any time. Material changes will be communicated through the App, the Website, or via email.
4. User Content
"User Content" means any content that you create, upload, store, or otherwise submit through the App, including notes, descriptions, images, videos, and metadata.
You retain full ownership of your User Content. You grant MMENTO a limited, non-exclusive, royalty-free licence solely to the extent strictly necessary to operate, host, secure, back up, and provide the Services to you. This licence does not authorise MMENTO to use your User Content for any purpose other than delivering the Services to you.
We do not sell User Content. We do not use User Content to train artificial intelligence models, whether our own or those of third parties. We do not access User Content except in the limited circumstances described in our Privacy Policy and in the Transparency section dedicated to the MMENTO App.
You are solely responsible for the legality, accuracy, and ownership of your User Content. You represent that you have the necessary rights to upload and store such content, and that it does not infringe any third-party rights.
5. Acceptable Use
When using the Services, you agree not to:
- Violate any applicable law or regulation.
- Infringe the intellectual property, privacy, or other rights of any third party.
- Upload content that is unlawful, defamatory, harassing, or abusive.
- Reverse engineer, decompile, or attempt to extract the source code of the Services, except to the extent expressly permitted by mandatory law.
- Use the Services to develop a competing product, scrape data at scale, or interfere with the normal operation of the Services.
- Attempt to gain unauthorised access to other users' accounts or to MMENTO's systems.
We reserve the right to suspend or terminate accounts that violate these provisions.
6. Subscriptions and Payments
Certain features of the App are available through paid subscriptions. The current price, billing cycle, and features included are displayed at the point of purchase within the App.
Subscriptions are processed through the in-app purchase systems of the relevant mobile application stores. Billing, automatic renewal, and cancellation are governed by the terms of the store through which the subscription was purchased.
Right of Withdrawal (EU consumers)
Users residing in the European Union have the right to withdraw from a digital service contract within fourteen (14) days from the date of purchase, in accordance with Articles 102–108 of the consolidated Spanish Consumer Protection Act (Real Decreto Legislativo 1/2007).
This right is lost when the consumer expressly consents to the immediate provision of the digital service and acknowledges that this consent results in the loss of the right of withdrawal, in accordance with Article 103(m) of the same Act.
For subscriptions purchased through a mobile application store, refund requests are handled directly by the store under its own refund policy. We will assist users with such requests where reasonably possible.
7. Cancellation and Termination
You may cancel your subscription at any time through your account settings within the relevant application store. You may also delete your MMENTO account at any time from within the App.
When you delete your account, we initiate the deletion of your User Content from our active production systems. Residual copies may persist in encrypted backups for a maximum of thirty (30) days, after which they are automatically purged.
We may suspend or terminate your account, with or without notice, if you materially breach these Terms, if your account is used in connection with fraud or abuse, or if required by law.
8. Intellectual Property of the Services
The Services, including their software, design, structure, interface, and the MMENTO™ brand, are the exclusive property of Display Group LTD and are protected by intellectual property laws.
These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services solely for their intended purpose. No other rights are granted.
9. Third-Party Content (MMENTO Explore)
MMENTO Explore presents reinterpreted, editorialised summaries of magic-related products commercialised by third-party retailers. The original product names, brands, and trademarks displayed within Explore remain the exclusive property of their respective owners.
Product images shown in Explore are loaded directly from the retailers' own servers and are not stored or republished by MMENTO. We do not claim ownership over any third-party content.

10. Disclaimers
The Services are provided "as is" and "as available". To the maximum extent permitted by applicable law, MMENTO disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, or free from security vulnerabilities, although we apply reasonable industry-standard measures to keep the Services secure.
11. Limitation of Liability
To the maximum extent permitted by applicable law, MMENTO's total aggregate liability arising out of or in connection with the Services shall not exceed the amount paid by you for the Services during the twelve (12) months immediately preceding the event giving rise to the liability.
In no event shall MMENTO be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities, even if advised of the possibility of such damages.
Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under mandatory applicable law, including liability for fraud, gross negligence, or wilful misconduct.
12. Modifications to the Terms
We may update these Terms from time to time. Material changes will be communicated through the App, the Website, or via email. The "Last updated" date at the top of this document indicates the date of the most recent revision.
Continued use of the Services after changes have been published constitutes acceptance of the revised Terms.
13. Applicable Law and Jurisdiction
These Terms are governed by Spanish law and the applicable regulations of the European Union, without prejudice to mandatory consumer protection rules that may apply in the user's country of residence.
Disputes arising from these Terms shall be submitted to the jurisdiction of the courts of Spain, except where mandatory law provides otherwise.
